Terms of Service

These Terms of Service ("Terms") are entered into by and between you ("User," "you," or "your") and ChristaPix LLC ("ChristaPix," "Company," "we," "us," or "our"), an Illinois limited liability company.

These Terms govern your access to and use of christapix.com, the ChristaPix web application, SMS/MMS messaging services (including 815-247-4782), and all related features, content, functionality, and services (collectively, the "Service").

By accessing or using the Service, including by sending a photo via SMS/MMS, uploading an image through the website, or placing an order, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

1. Service Description

ChristaPix is a web- and SMS-enabled platform that allows users to:

  • Submit photographs via SMS/MMS or web upload;
  • Edit, crop, rotate, and customize those photographs;
  • Generate or compose postcard messages, including through optional AI-assisted tools;
  • Provide recipient mailing details;
  • Purchase physical 4x6 postcards that are printed and mailed to designated recipients.

ChristaPix uses third-party providers for messaging transmission, payment processing, AI text generation, and printing and mailing fulfillment.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

2. Eligibility

You must be at least eighteen (18) years old and have legal capacity to enter into binding agreements to use the Service.

By using the Service, you represent and warrant that you meet these requirements.

The Service is not directed to children under the age of 18. Under no circumstances may a child under 18 use the Service.

3. Account and Access

Certain features of the Service may require you to provide a phone number or create an account. You agree to provide accurate, current, and complete information.

You are responsible for maintaining the security of your account and for all activity that occurs under your account or phone number.

We reserve the right to suspend or terminate access if we believe, in our sole discretion, that you have violated these Terms.

4. Orders and Fulfillment

4.1 Order Acceptance

Your submission of an order does not constitute acceptance by ChristaPix. An order is accepted only when payment has been successfully processed and confirmation has been issued.

We reserve the right to refuse or cancel any order at our sole discretion.

4.2 Printing and Delivery

Postcards are printed and mailed through third-party fulfillment providers. Delivery timelines are estimates only. We do not guarantee delivery dates.

Once an order is submitted for printing, it cannot be modified or cancelled.

ChristaPix is not responsible for delays caused by postal carriers, incorrect addresses provided by you, force majeure events, or circumstances beyond our reasonable control.

5. Pricing and Payment

All prices are listed in U.S. Dollars.

Payment processing is handled by authorized third-party processors. ChristaPix does not store full payment card details.

By submitting payment information, you represent that:

  • You are authorized to use the payment method;
  • The information provided is accurate;
  • Sufficient funds are available.

We reserve the right to change pricing at any time. Price changes do not affect completed orders.

6. Refund Policy

Because postcards are personalized printed goods, all sales are final once submitted for production. Please see our Refund Policy for full details.

7. User Content and License

You retain ownership of photographs, text, and other content you submit ("User Content").

By submitting User Content, you grant ChristaPix a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, modify (including cropping and formatting), transmit, print, and distribute your content solely for the purpose of operating, improving, and fulfilling the Service.

This license terminates once content is deleted from our systems, subject to backup and legal retention requirements.

8. Content Restrictions

You may not upload or transmit content that:

  • Is unlawful, defamatory, obscene, or threatening;
  • Promotes violence, discrimination, or hate;
  • Infringes intellectual property rights;
  • Violates privacy rights;
  • Contains explicit sexual material;
  • Constitutes harassment or abuse;
  • Is fraudulent or misleading.

We reserve the right to refuse to print or transmit any content in our sole discretion. We may cooperate with law enforcement and disclose information where required by law.

9. AI-Generated Content Disclaimer

ChristaPix may offer AI-assisted message generation. AI-generated content:

  • Is provided for convenience only;
  • May contain inaccuracies;
  • Should be reviewed by you prior to printing.

You are solely responsible for reviewing and approving final postcard content. ChristaPix disclaims all liability arising from AI-generated content.

10. Prohibited Uses

You agree not to:

  • Use the Service for unsolicited mass mailings or harassment;
  • Attempt to reverse engineer the platform;
  • Interfere with system operations;
  • Use automated systems to exploit the Service;
  • Use the Service for commercial bulk mailing without authorization.

11. Intellectual Property

All ChristaPix trademarks, logos, designs, software, and website content are owned by ChristaPix LLC. You may not reproduce, distribute, or exploit any part of the Service without written permission.

12. Third-Party Services

The Service integrates third-party providers for SMS/MMS transmission, printing and mailing, payment processing, and AI text generation. Your use of these integrated services may be subject to their respective terms and policies. ChristaPix is not liable for third-party performance or failures.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." CHRISTAPIX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free;
  • Messages will be delivered without delay;
  • The Service is free of viruses or harmful code.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

ChristaPix shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, goodwill, or data.

Our total aggregate liability shall not exceed the total amount paid by you to ChristaPix in the twelve (12) months preceding the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless ChristaPix and its officers, members, employees, contractors, and service providers from any claims arising from your violation of these Terms, your User Content, your misuse of the Service, or any infringement of third-party rights.

16. Text Messaging Consent

By texting 815-247-4782 or otherwise opting in:

  • You consent to receive SMS/MMS messages related to your postcard orders, including automated messages.
  • Message frequency varies.
  • Message and data rates may apply.
  • You may opt out by replying STOP.
  • For help, reply HELP.

Consent is not a condition of purchase.

17. Termination

We may suspend or terminate access at any time, with or without notice, for any violation of these Terms or for any reason in our sole discretion.

18. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Illinois. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Cook County, Illinois. You consent to personal jurisdiction and venue in such courts.

19. Limitation on Time to File Claims

Any claim arising out of these Terms must be commenced within one (1) year after the cause of action accrues, or it is permanently barred.

20. Changes to Terms

We may revise these Terms at any time. Updated Terms will be posted with a revised Effective Date. Your continued use of the Service constitutes acceptance of the revised Terms.

ChristaPix LLC ("ChristaPix," "Company," "we," "us," or "our") respects your privacy and is committed to protecting your personal information.

This Privacy Policy describes how we collect, use, disclose, and safeguard information when you use christapix.com, send messages to 815-247-4782, upload photos, create postcards, or otherwise interact with our services (collectively, the "Service").

By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

1. Information We Collect

We collect information directly from you, automatically through your use of the Service, and from service providers.

1.1 Information You Provide

When you use ChristaPix, you may provide:

  • Your phone number (via SMS/MMS interaction)
  • Your name (if provided)
  • Recipient name and mailing address
  • Uploaded photographs
  • Postcard message text
  • Payment information (processed via our payment provider)
  • Customer support communications

1.2 Photo Metadata

Uploaded images may contain embedded metadata (EXIF data), which can include date and time, device information, and geolocation coordinates. We may use metadata solely to enhance postcard creation features (for example, AI message suggestions or contextual references). Metadata is not used for marketing profiling.

1.3 Automatically Collected Information

We may automatically collect:

  • IP address
  • Browser type
  • Device type
  • Operating system
  • Referring pages
  • Access timestamps
  • Usage patterns within the web editor

This information is used for security, fraud prevention, debugging, and service improvement.

2. How We Use Your Information

We use your information to:

  • Create, print, and mail postcards
  • Process payments
  • Provide AI-assisted message suggestions (if used)
  • Send transactional SMS or email communications
  • Provide customer support
  • Detect fraud and abuse
  • Improve Service functionality
  • Comply with legal obligations
  • Send promotional communications and marketing materials (where permitted)

We do not sell your personal information. We may use information you provide, including usage data and order history, to improve our services and send you relevant marketing communications.

3. Text Message Communications

If you text our number (815-247-4782), we collect and process your phone number and message content to:

  • Respond to your submission
  • Provide preview links
  • Confirm orders
  • Send transactional updates

Message frequency varies. Standard carrier messaging and data rates may apply. You may opt out at any time by replying STOP.

4. Third-Party Service Providers

We use trusted third-party providers to operate the Service. These providers process information on our behalf:

4.1 SMS/MMS Transmission

Your phone number and message content are transmitted through our messaging service provider to deliver and receive SMS/MMS communications.

4.2 Printing and Mailing

Recipient name, address, and postcard content are shared with our fulfillment provider for printing and mailing.

4.3 Payment Processing

Payment card details are transmitted directly to our payment processor. ChristaPix does not store full card numbers. Your payment details are subject to our payment processor's privacy policy.

4.4 AI Text Generation

If you use AI-assisted text generation, limited contextual information (such as photo description or metadata) may be transmitted to our AI provider to generate suggestions. We do not send your phone number or payment details to our AI provider.

4.5 Hosting

Our infrastructure is hosted on secure cloud servers. Data is stored in encrypted databases and secured environments.

Each provider is contractually obligated to protect your data and process it solely for service delivery purposes.

5. Data Retention

We retain personal information only as long as reasonably necessary to:

  • Fulfill postcard orders
  • Handle customer support inquiries
  • Comply with tax and accounting requirements
  • Enforce our Terms

General Retention Guidelines:

  • Photos and postcard content: Typically deleted within 30 days after order fulfillment unless needed for dispute resolution.
  • Transaction records: Retained for up to 7 years for accounting and legal compliance.
  • SMS logs: Retained as required for regulatory and fraud prevention purposes.

We may retain limited archival backups for security and legal compliance.

6. Data Sharing and Disclosure

We may disclose personal information:

  • To service providers described above
  • To comply with legal obligations
  • To respond to subpoenas or lawful requests
  • To enforce our Terms
  • To protect the rights, safety, or property of ChristaPix or others
  • In connection with a merger, acquisition, or asset sale

We do not sell personal information for monetary consideration.

7. Cookies and Tracking Technologies

ChristaPix uses cookies and similar technologies to:

  • Maintain session state
  • Enable checkout functionality
  • Analyze site usage
  • Improve user experience

You may adjust browser settings to disable cookies; however, certain features may not function properly. We do not use invasive behavioral advertising networks.

8. Security

We implement commercially reasonable technical and organizational safeguards, including:

  • HTTPS encryption
  • Secure database storage
  • Restricted internal access controls
  • Third-party PCI-compliant payment processing

However, no system can guarantee absolute security.

9. Children's Privacy

ChristaPix is not intended for use by children under 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected such information, we will delete it promptly.

10. Your Privacy Rights

Depending on your jurisdiction, you may have rights to:

  • Access your personal information
  • Request correction
  • Request deletion
  • Request restriction of processing
  • Receive a copy of your data

11. California Privacy Rights (CCPA/CPRA)

12. Do Not Track

Our Service does not currently respond to "Do Not Track" browser signals.

13. International Users

ChristaPix operates in the United States. If you access the Service from outside the U.S., you consent to the transfer and processing of your information in the United States.

14. Business Transfers

If ChristaPix is involved in a merger, acquisition, reorganization, or sale of assets, personal information may be transferred as part of that transaction.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Changes will be posted with an updated Effective Date. Your continued use of the Service after changes are posted constitutes acceptance of the revised policy.

Refund Policy

Effective Date: February 22, 2026

Because ChristaPix postcards are personalized physical products that are printed and mailed, all sales are final once submitted for production. We are unable to recall or cancel a postcard once it has been sent to print. Please review your postcard carefully before placing your order.

Refund Eligibility

We may, at our sole discretion, offer a refund or reprint in the following circumstances:

  • Print quality defects — if your postcard contains a material printing error or damage that occurred during production.
  • Delivery failure due to system error — if the order was not fulfilled due to a technical error on our end (not due to an address you entered incorrectly).
  • Wrong content printed — if the wrong content was printed due to our technical error.

Not Eligible for Refund

  • Errors in addresses provided by you.
  • Low-resolution images uploaded by you.
  • Dissatisfaction with subjective design choices.
  • Postal delays.
  • Change of mind after the order has been submitted.
  • Minor smudges or surface marks — postcards are sent as open mail and may pick up marks during postal handling, which is outside our control.

How to Request a Refund

To request a refund, please email [email protected] with your order details and a description of the issue. If applicable, please include a photo of the received postcard showing the defect.

Processing Time

We aim to review all refund requests within 5 business days. Approved refunds will be initiated within 5–10 business days. The time for the credit to appear on your account depends on your bank or card issuer and is outside our control. All refund determinations are made in our sole discretion.

Mobile Terms of Service

By texting 815-CHRISTA (815-247-4782) or otherwise opting in, you consent to receive SMS and MMS messages from ChristaPix related to your postcard orders, including automated messages necessary to process, preview, and deliver your postcard.
